Latics captain Samy Morsy will not face a three match suspension following the red card received during our 2-0 defeat to Brentford FC at Griffin Park on Saturday, with the FA Regulatory Commission accepting the club's claim of wrongful dismissal and excessive punishment.
The red card will remain on Morsy's record, but will not be taken into account should he be dismissed again this season, therefore he would not serve any additional suspension.
Morsy, to the delight of his manager Paul Cook, will be available for selection for Latics' Sky Bet Championship clash with Hull City on Tuesday night.
"It's great news for us and Samy and clearly the correct decision," Cook said.
"My immediate reaction to it was both lads putting their heads in to try and head the ball, and when you get that then it's an accidental clash of heads.
"Naturally we're delighted to have our captain available for selection for what are three difficult fixtures, starting with Hull on Tuesday night."
